Privacy Policy

At Upendo Tena Initiative, we are committed to protecting your personal information. Therefore, it will never be handed over to external organisations and will only be disclosed to those acting as agents and data processors carrying out work on our behalf. When we enter into a relationship with an external party, any such arrangements will be subject to a formal agreement between Upendo Tena Initiative and that organisation to protect the security of your data. We will only use your personal information in accordance with all applicable laws concerning the protection of personal information and will not do anything with your information you would not reasonably expect.

This Privacy Policy sets out how and why we obtain, use and protect your personal information.

Key points:

  • We will only send you marketing information electronically (e.g. by email, text/SMS, social media). This would only be occasionally and only with your consent.
  • If you ask us to stop sending marketing information we will update our records as soon as possible and this will stop any further mailings to you. However, please be aware that you may still receive mailings for up to 28 days. This will be because we are in the process of taking your details off the mailing list and something prior may have already been lined up to be sent out. 
  • We collect personal data e.g. your name, email addresses, phone number, when you give them to us for various purposes, such as donating, seeking advice, signing up for an event, or applying for a position. 
  • We gather information about traffic to and on our website to improve the site and for marketing purposes. We use cookies and tags on our website.
  • If we rely on consent to process your data, you can withdraw your consent at any time.
  • You will be updated on any changes to the policy that may affect the way we handle your personal data. 

Sharing and holding your data

Under certain circumstances we will share data with the appropriate authorities (e.g. police, law enforcement agencies and other parties) where we have a legal obligation to do so. 

Your information, including Personal Information, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those from your jurisdiction. This is because we are a registered NGO in Kenya, but a lot of our operational work is carried out in the United Kingdom. In general, the personal information that we collect is stored at a destination within the United Kingdom. However, your personal information may sometimes be transferred or stored outside the United Kingdom, if there is a reason to do so. 

If you are located outside the United Kingdom and choose to provide information to us, please note that we transfer the information, including Personal Information, to the United Kingdom and process it there.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

How we get the personal information and why we have it 

Most of the personal information we process is provided to us directly by you for one of the following reasons: 

  • You signed up to receive our emails.
  • You applied for a staff or volunteer position with us.
  • You engage with us in a professional, commercial, or other work capacity.
  • You made a donation to us, either by bank transfer, online (either directly through our website or by using a third-party donation platform such as JustGiving or CAF), over the phone or via SMS. We also collect information about you when you make a donation to us through setting up a standing order or Direct debit. 
  • The information we collect when you make a donation does not include credit card information.
  • You contacted us via phone or email and signed up to support our work by fundraising for us by taking part in a challenge, event, or other means.
  • You reached out to us for any other reason.

We also hold information about your engagement with us including the ways you have supported us in the past, for example, through donating, or utilising our services.

We also receive personal information indirectly, from the following sources in the following scenarios: 

  • E.g. JustGiving, an online portal and service for individual donors and people organising fundraising events for us. For further details please read JustGiving’s privacy policy on their website. If you choose to donate anonymously, we will not have any of your personal details. We will only know the date and amount of your donation. 

If you have donated through our website or another website, we may receive a personal identity number which would enable the other company to answer any particular questions about your gift.

Collecting Personal Data

We collect personal data to allow us to process: 

  • Donations
  • ⁠Information about fundraising events people are running or taking part in for us
  • ⁠Job and volunteer applications 
  • Requests for our services
  • ⁠Information about the children and young people who access support through Upendo Tena Initiative, to get a better understanding of their experiences. This involves compiling statistics, undertaking research and communicating our work publicly using anonymous information from service users. We will never share anything that identifies any individual person without their permission.

This policy is written in accordance with the General Data Protection Regulation.
